{"id":5698,"date":"2023-11-29T10:43:18","date_gmt":"2023-11-29T09:43:18","guid":{"rendered":"https:\/\/www.cplaw.rs\/?p=5698"},"modified":"2023-11-29T10:52:24","modified_gmt":"2023-11-29T09:52:24","slug":"zelena-gradnja-i-unapredenje-energetske-efikasnosti-objekata","status":"publish","type":"post","link":"https:\/\/www.cplaw.rs\/sr\/zelena-gradnja-i-unapredenje-energetske-efikasnosti-objekata\/","title":{"rendered":"Zelena gradnja i unapre\u0111enje energetske efikasnosti objekata"},"content":{"rendered":"<p style=\"text-align: justify;\">Zakonom o izmenama i dopunama Zakona o planiranju i izgradnji koji je stupio na snagu 04. avgusta 2023. godine (u daljem tekstu: \u201e<strong>Zakon<\/strong>\u201c) uvode se, izme\u0111u ostalog, i novine u oblasti zelene gradnje i unapre\u0111enja energetske efikasnosti objekata. U nastavku ovog teksta izdvajamo neke od najzna\u010dajnijih novina u ovoj oblasti.<\/p>\n<p style=\"text-align: justify;\">Zakonom se prvi put defini\u0161e pojam <strong><em>\u201czelena gradnja\u201d<\/em><\/strong> kao na\u010din planiranja, projektovanja, izvo\u0111enja radova, kori\u0161\u0107enja i odr\u017eavanja objekata, kojima se smanjuje emisija gasova sa efektom staklene ba\u0161te, koriste ekolo\u0161ki sertifikovani gra\u0111evinski materijali i oprema, efikasno koriste svi resursi, smanjuje produkcija i pove\u0107ava kori\u0161\u0107enje otpada od gra\u0111enja i ru\u0161enja po modelu cirkularnosti, koriste obnovljivi izvori energije, \u0161to dovodi do pobolj\u0161anja kvaliteta \u017eivota korisnika, za\u0161tite \u017eivotne sredine i unapre\u0111uje odr\u017eivost.<\/p>\n<p style=\"text-align: justify;\">S tim u vezi, Zakon predvi\u0111a da se za sve nove zgrade preko 10.000 m<sup>2<\/sup> bruto razvijene gra\u0111evinske povr\u0161ine pribavlja <strong>sertifikat zelene gradnje<\/strong> kojim se potvr\u0111uje da je objekat ispunio zadate kriterijume. Sertifikat zelene gradnje predstavlja potvrdu izdatu od strane me\u0111unarodnog sistema za sertifikaciju zelenih zgrada koja slu\u017ei za ocenjivanje kvaliteta i stepena ispunjenosti kriterijuma zelene gradnje. Ovaj sertifikat \u0107e ubudu\u0107e omogu\u0107avati investitorima da ostvare pogodnosti, budu\u0107i da je kao jedna od mera podsticanja zelene gradnje predvi\u0111eno pravo na umanjenje obra\u010dunatog doprinosa za ure\u0111ivanje gra\u0111evinskog zemlji\u0161ta u visini od 10% ukupno odre\u0111enog iznosa doprinosa.<\/p>\n<p style=\"text-align: justify;\">Kada govorimo o <strong>sertifikatu o energetskim svojstvima zgrade (energetski paso\u0161)<\/strong>, koji prikazuje energetska svojstva zgrade i koji se izdaje kroz Centralni registar energetskih paso\u0161a (CREP), ideja je da ubudu\u0107e sve zgrade poseduju ovaj sertifikat. Iz tog razloga, Zakon predvi\u0111a da, od dana njegovog stupanja na snagu, sve nove zgrade moraju da poseduju energetski paso\u0161, dok su za postoje\u0107e zgrade propisani rokovi u kojima vlasnici moraju pribaviti isti, i to:<\/p>\n<ul style=\"text-align: justify;\">\n<li>vlasnici postoje\u0107ih zgrada javne namene u javnoj svojini u roku od 3 godine,<\/li>\n<li>vlasnici postoje\u0107ih poslovnih zgrada u roku od 5 godina, i<\/li>\n<li>vlasnici postoje\u0107ih stambenih zgrada u roku od 10 godina.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p style=\"text-align: justify;\">Nepribavljanje energetskog paso\u0161a u navedenim rokovima, ima za posledicu prekr\u0161ajnu odgovornost vlasnika postoje\u0107ih zgrada, za koju su predvi\u0111ene nov\u010dane kazne. Pored navedenog, izmenama Zakona propisuje se i da se energetski paso\u0161 obavezno prila\u017ee prilikom overe ugovora o kupoprodaji nepokretnosti ili zaklju\u010denja ugovora o zakupu i da \u010dini njegov sastavni deo. Ipak, budu\u0107i da su za vlasnike postoje\u0107ih zgrada propisani gorepomenuti rokovi u kojima moraju pribaviti energetski paso\u0161, Zakon predvi\u0111a da se do isteka tih rokova prilikom overe ugovora o kupoprodaji nepokretnosti i zaklju\u010denja ugovora o zakupu nepokretnosti, ne prila\u017ee energetski paso\u0161.
