Neustavne odredbe zakona<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">Dana 20.04.2011. godine u Slu\u017ebenom glasniku RS broj 27\/2011 objavljena je Odluka Ustavnog suda kojom su progla\u0161ene za neustavne odredbe Zakona o odr\u017eavanju stambenih zgrada (\u201eSlu\u017ebeni glasnik RS\u201c broj 44\/95,46\/98 i 1\/01), koje propisuju da skup\u0161tina stanara zgrade, <span style=\"text-decoration: underline;\">saglasno\u0161\u0107u vlasnika stanova i drugih posebnih delova zgrade kojima pripada vi\u0161e od polovine ukupne povr\u0161ine stanova i drugih posebnih delova zgrade<\/span>, mo\u017ee da donese odluku:<\/p>\n<p style=\"text-align: justify;\">\u2022 o izvo\u0111enju radova na sanaciji ravnog krova, odnosno krovne konstrukcije kojom se, saglasno propisima o planiranju i ure\u0111enju prostora i izgradnji objekata, mo\u017ee izgraditi odnosno adaptirati novi stan;<br \/>\n\u2022 o pretvaranja zajedni\u010dke prostorije u stan ili poslovni prostor;<br \/>\n\u2022 o pripajanju zajedni\u010dke prostorije susednom stanu odnosno potkrovnoj prostoriji, ako ta prostorija ne ispunjava propisane uslove za pretvaranje u poseban stan;<br \/>\n\u2022 da prethodno pomenute radove mo\u017ee da izvede i neko od vlasnika stanova ili \u010dlanova njihovog porodi\u010dnog doma\u0107instva ili tre\u0107e lice ako se utvrdi da vlasnici ili \u010dlanovi njihovog doma\u0107instva nisu za to zainteresovani.<\/p>\n<p style=\"text-align: justify;\">Ustavni sud je predmetnu Odluku doneo uzimaju\u0107i u obzir odredbe Zakona o osnovama svojinskopravnih odnosa koje propisuju da vlasnici posebnih delova zgrade imaju zajedni\u010dku nedeljivu svojinu na zajedni\u010dkim prostorijama, te sledstveno tome vlasnik posebnog dela zgrade ve\u0107e povr\u0161ine ne mo\u017ee imati ve\u0107a svojinska ovla\u0161\u0107enja na zajedni\u010dkim prostorijama od vlasnika posebnog dela zgrade manje povr\u0161ine, odnosno da svi vlasnici imaju jednaka svojinska ovla\u0161\u0107enja. Prilikom odlu\u010divanja, Ustavni sud je, tako\u0111e, imao u vidu da je Ustavom Republike Srbije propisano da se pravo svojine ne mo\u017ee ograni\u010diti, osim u javnom interesu utvr\u0111enim zakonom.<\/p>\n<p style=\"text-align: justify;\"><strong><em>2. Predlog dopuna zakona<\/em><\/strong><\/p>\n<p style=\"text-align: justify;\">Predlogom Zakona o dopunama Zakona o odr\u017eavanju stambenih zgrada (<strong>Predlog Zakona<\/strong>) koji je objavljen dana 01.08.2011. godine na sajtu Narodne skup\u0161tine Srbije <span style=\"text-decoration: underline;\">predvi\u0111eno je da \u0107e se gore navedene odluke skup\u0161tine stanara zgrade donositi ve\u0107inom od ukupnog broja \u010dlanova skup\u0161tine zgrade<\/span>.<\/p>\n<p style=\"text-align: justify;\">3. Retroaktivna primena i otklanjanje posledica neustavnih odredbi zakona<\/p>\n<p style=\"text-align: justify;\">Zakonom o Ustavnom sudu propisano je da svako kome je povre\u0111eno pravo kona\u010dnim ili pravosna\u017enim pojedina\u010dnim aktom, donetim na osnovu zakona ili drugog op\u0161teg akta, za koji je Odlukom Ustavnog suda utvr\u0111eno da nije u saglasnosti sa Ustavom, ima pravo da tra\u017ei od nadle\u017enog organa izmenu tog pojedina\u010dnog akta. Predlog za izmenu neustavnog pojedina\u010dnog akta mo\u017ee se podneti <span style=\"text-decoration: underline;\">u roku od \u0161est meseci<\/span> od dana objavljivanja odluke Ustavnog suda, pod uslovom da od dana dostavljanja pojedina\u010dne odluke do podno\u0161enja predloga ili inicijative za pokretanje postupka <span style=\"text-decoration: underline;\">nije proteklo vi\u0161e od dve godine<\/span>. Ukoliko se utvrdi da se izmenom pojedina\u010dnog akta ne mogu otkloniti posledice nastale primenom neustavnog op\u0161teg akta, Ustavni sud mo\u017ee odrediti da se ove posledice otklone povra\u0107ajem u pre\u0111a\u0161nje stanje, naknadom \u0161tete ili na drugi na\u010din.<\/p>\n<p style=\"text-align: justify;\">Stoga, svako kome je povre\u0111eno pravo odlukama skup\u0161tine stanara o raspolaganju zajedni\u010dkim prostorijama, ima mogu\u0107nost da Ministarstvu \u017eivotne sredine, rudarstva i prostornog planiranja (<strong>Ministarstvo<\/strong>) podnese <span style=\"text-decoration: underline;\">predlog za izmenu takvih odluka skup\u0161tine stanara zgrade<\/span>, u zakonom predvi\u0111enom roku.<\/p>\n<p style=\"text-align: justify;\">Ostaje da se vidi kako \u0107e Ministarstvo, kao nadle\u017eni organ za primenu predmetne Odluke Ustavnog suda, do dono\u0161enja Zakona o dopunama Zakona o odr\u017eavanju stambenih zgrada postupati po primljenim predlozima za izmenu i otklanjanje posledica neustavnih odluka skup\u0161tina stanara zgrade.<\/p>\n<p style=\"text-align: justify;\"><a href=\"https:\/\/www.cplaw.rs\/wp-content\/uploads\/2011\/10\/Zakon-o-odr--avanju-stambenih-zgrada.pdf\">Preuzmite PDF bilten: Zakon o odr\u017eavanju stambenih zgrada<\/a><\/p>\n<p style=\"text-align: justify;\"><span style=\"color: #999999;\"><em>Odricanje od odgovornosti: Tekst u prilogu \u0161alje se kao op\u0161te uputstvo i ne predstavlja pravni savet.
