{"id":1706,"date":"2020-03-18T15:28:48","date_gmt":"2020-03-18T15:28:48","guid":{"rendered":"https:\/\/www.cplaw.rs\/?p=1706"},"modified":"2021-10-12T08:27:26","modified_gmt":"2021-10-12T08:27:26","slug":"obaveze-poslodavaca-za-vreme-vanrednog-stanja","status":"publish","type":"post","link":"https:\/\/www.cplaw.rs\/sr\/obaveze-poslodavaca-za-vreme-vanrednog-stanja\/","title":{"rendered":"Obaveze poslodavaca za vreme vanrednog stanja"},"content":{"rendered":"<p style=\"text-align: justify;\">U skladu sa progla\u0161enjem vanrednog stanja na teritoriji Republike Srbije, a usled pandemije korona virusa Kovid-19, 16. marta 2020. godine po\u010dela je sa primenom Uredba o organizovanju rada poslodavaca za vreme vanrednog stanja, koja je objavljena u \u201cSl. glasniku RS\u201d, br. 31\/2020 (dalje: \u201eUredba\u201c).<\/p>\n<p style=\"text-align: justify;\">Uredbom se ure\u0111uje poseban na\u010din organizacija rada poslodavaca na teritoriji Republike Srbije za vreme vanrednog stanja, a pre svega:<br \/>\n\u2212 obavljanje poslova van prostorija poslodavca;<br \/>\n\u2212 uvo\u0111enje smenskog rada;<br \/>\n\u2212 omogu\u0107avanje odr\u017eavanja svih poslovnih sastanaka elektronskim, odnosno drugim odgovaraju\u0107im putem (video link, video poziv i dr.); kao i<br \/>\n\u2212 odlaganje slu\u017ebenih putovanja u zemlji i inostranstvu, u skladu sa odlukom nadle\u017enog organa o zabrani, odnosno privremenom ograni\u010denju ulaska i kretanja.<\/p>\n<p style=\"text-align: justify;\">U skladu sa pomenutom Uredbom, za vreme vanrednog stanja poslodavac je du\u017ean da omogu\u0107i zaposlenima obavljanje poslova van prostorija poslodavca (rad na daljinu i rad od ku\u0107e), na svim radnim mestima na kojima je mogu\u0107e organizovati takav rad u skladu sa op\u0161tim aktom i ugovorom o radu.<\/p>\n<p style=\"text-align: justify;\">Ako op\u0161tim aktom i ugovorom o radu nije predvi\u0111en navedeni na\u010din rada, poslodavac mo\u017ee re\u0161enjem omogu\u0107iti zaposlenom obavljanje poslova van prostorija poslodavca, ukoliko mu to organizacioni uslovi dozvoljavaju.<br \/>\nRe\u0161enje o obavljanju poslova van prostorija poslodavca obavezno sadr\u017ei:<br \/>\n1) trajanje radnog vremena;<br \/>\n2) na\u010din vr\u0161enja nadzora nad radom zaposlenog.<\/p>\n<p style=\"text-align: justify;\">Poslodavac je tako\u0111e du\u017ean da vodi evidenciju o zaposlenima koji obavljaju rad van prostorija poslodavca.<br \/>\nPoslodavac \u010dija je priroda delatnosti takva da nije mogu\u0107e organizovati rad van prostorija, neophodno je da svoje poslovanje uskladi sa uslovima vanrednog stanja i to:<br \/>\n\u2212 da, ukoliko je to mogu\u0107e i ne iziskuje dodatna sredstva, organizuje rad u smenama, kako bi \u0161to manji broj zaposlenih i svih drugih radno anga\u017eovanih lica rad obavljao istovremeno u jednoj prostoriji;<br \/>\n\u2212 omogu\u0107i odr\u017eavanje svih poslovnih sastanaka elektronskim, odnosno drugim odgovaraju\u0107im putem (video link, video poziv i dr.);<br \/>\n\u2212 odlo\u017ei slu\u017ebena putovanja u zemlji i inostranstvu, u skladu sa odlukom nadle\u017enog organa o zabrani, odnosno privremenom ograni\u010denju ulaska i kretanja.<\/p>\n<p style=\"text-align: justify;\">Uredbom je propisano i da je poslodavac du\u017ean da, u cilju osiguranja za\u0161tite i zdravlja zaposlenih, radno anga\u017eovanih i stranaka, obezbedi sve op\u0161te, posebne i vanredne mere koje se odnose na higijensku sigurnost objekata i lica u skladu sa Zakonom o za\u0161titi stanovni\u0161tva od zaraznih bolesti.<\/p>\n<p style=\"text-align: justify;\">Za zaposlene i radno anga\u017eovane, koji su u neposrednom kontaktu sa strankama ili dele radni prostor sa vi\u0161e lica, potrebno je obezbediti dovoljne koli\u010dine za\u0161titne opreme u skladu sa posebnim propisima.<\/p>\n<p style=\"text-align: justify;\">Dodatno, na sednici Vlade Republike Srbije doneta je Naredba o ograni\u010denju i zabrani kretanja lica na teritoriji Republike Srbije (&#8222;Sl. glasnik RS&#8220;, br. 34\/2020) koja je stupila na snagu 18.03.2020. godine, a koja podrazumeva potpunu zabranu kretanja na javnim mestima, odnosno van stanova, prostorija i objekata za stanovanje u stambenim zgradama i izvan doma\u0107instva licima sa navr\u0161enih 65 i vi\u0161e godina \u017eivota &#8211; u naseljenim mestima preko 5000 stanovnika, odnosno licima sa navr\u0161enih 70 i vi\u0161e godina \u017eivota &#8211; u naseljenim mestima do 5000 stanovnika, dok se ostalim licima zabranjuje kretanje na javnim mestima u vremenu od 20 do 05 \u010dasova.<\/p>\n<p style=\"text-align: justify;\">S tim u vezi, poslodavci koji imaju organizovan rad u no\u0107nim smenama ili rad van ovog predvi\u0111enog okvira dozvoljenog kretanja, potrebno je da se prijave Privrednoj Komori Srbije i dostave kontakt podatke osobe zadu\u017eene za koordinaciju ove aktivnosti, mati\u010dni broj i naziv dru\u0161tva, kako bi obezbedili dozvole za svoje zaposlene da neometano obavljaju svoje radne obaveze.
