Harmonization of limited liability companies with the Company Law

In focus: the new Company Law (“Official Gazette of the Republic of Serbia” no. 36/2011 dated May 27th, 2011) has entered into force on June 4th, 2011, and its application shall commence as of February 1st, 2012, except for several provisions which shall be applied as of January 1st, 2014.

Law on Maintenance of Residential Buildings

On April 20th 2011, the Decision of the Constitutional Court was announced in the Official Gazette of the Republic of Serbia no. 27/2011, declaring as unconstitutional provisions of the Law on Maintenance of Residential Buildings („Official Gazette of the Republic of Serbia“ no. 44/95,46/98 and 1/01) which prescribe that the assembly of the building’s tenants, by consent of the owners of apartments and other detached parts of the building who own more than half of the total surface of apartments and other detached parts of the building, can render certain decisions as described in the integral text.

Law on Enforcement and Security

In focus: the new Law on Enforcement and Security (hereinafter referred to as: the “Law”) was published in the “Official Gazette of the Republic of Serbia” no. 31/2011 on May 09th, 2011, entered into force on May 17th, 2011 and began to apply on September 17th, 2011. The Law contains solutions whose aim is to make the enforcement procedure faster and more efficient.

Law on Amendments and Addendums to the Law on Property Taxes

In focus: Law on Amendments and Addendums to the Law on Property Taxes (hereinafter referred to as: the „Law“) was published in the Official Gazette of the Republic of Serbia no. 24/2011 and entered into force on April 12, 2011, whereas its provisions which pertain to the subject of taxation, the determination of tax rates and tax exemptions are in application from January 1, 2011.

Law on Legal Practice

In focus: the new Law on Legal Practice (“Official Gazette of the Republic of Serbia”, no. 31/2011) which came into force on May 17, 2011 (from here on referred to as: the “Law”) stipulates the rules, conditions as well as forms for practice of law, rights and duties of attorneys at law and law trainees, together with the work of the Bar Association. The most significant changes introduced by this Law include the mandatory professional indemnity insurance for attorneys, the establishment of the Directory of Law Partnerships, the establishment of the Attorney Academy and the attorney exam, as well as the requirements for registration of attorneys– foreign nationals with the Serbian Bar Association.

Consumer Protection Law

In focus: the new Consumer Protection Law was rendered on the October 12th 2010 (Official Gazette of the Republic of Serbia, vol. 73/2010, hereinafter referred to as the “Law”). The Law is in force as of October 20th 2010, and actively enforced as of January 1st 2011.
